What Are Your Options?
In October of 2005, the U.S. Bankruptcy Code was changed. These changes were accompanied by a great deal of media attention, fear-mongering and misinformation. In reality, little has changed for most people seeking bankruptcy relief. In fact, the overwhelming majority of consumers — people who would have been eligible for relief under Chapter 7 before the law changed — would still be eligible today.

Moving Forward With the Bankruptcy Process
At the initial consultation, our attorneys will listen carefully as you talk about your current financial problems and the primary issues (credit cards, mortgages, creditor harassment, taxes, etc.) behind them. You will be asked a lot of questions. If you're worried about how your answers will sound to a stranger, don't be. We've heard many consumers' histories before and are here to help, not judge. Everything that is discussed is held under the strictest confidence.

Based on the information you provide, we'll identify the most appropriate options and discuss your alternatives with you. Whatever you decide, discretion and efficiency are important. Most cases can be handled in a relatively short time with few, if any, other people besides your creditors ever knowing a thing. Your bankruptcy petition will be filed electronically from our office at which point an automatic stay will go into effect that prevents even powerful creditors such as the IRS from continuing to contact or harass you about debts. Our firm has even been able to help clients who've come to see us at the last minute to obtain bankruptcy relief the very same day.

Firm Profile:

A Message from the Managing Attorney:

The Law Offices of Richard N. Gottlieb provide a superior level of client value in its primary areas of practice: bankruptcy and creditors' rights. The firm achieves this level of client value through meeting the needs of each client as though he/she were the firm's only client. Each member of the firm recognizes that the value of legal services is measured by the results sought and obtained as well as by the creativity and cost-effective manner in which those results are achieved. Furthermore, the value of legal services is ultimately for the informed client to determine based upon such intangible factors as: 1. the frequency and level of responsiveness to client communications; 2. the adherence to the highest levels of good faith and ethical behavior; 3. the ability to understand the client's financial issues and to pursue the client's goals with skill and zeal; and 4. the representation of the client with the client's financial issues and goals firmly in mind throughout the process. The firm provides this level of client value by attracting high-quality members and training them in the fundamentals of a bankruptcy and creditors' rights practice. The firm strives to foster in each staff member the sense that they are an integral part of the value the firm provides to its clients and that the clients' needs are the reason the firm is in business in the first place. In addition, the firm is committed to remaining relatively small to maximize client interaction with the members of the firm. - Richard N. Gottlieb, Esq., Founder and Managing Attorney

Creditors are subject to state law provisions incorporated into bankruptcy cases. If a bankruptcy court lifts the automatic stay and permits a specific creditor to seize and liquidate property subject to a lien, creditors must obey all state law limitations on collection practices. For more information, see legal assistance for debtors. Also, all statutory provisions depend on conformity with the prohibition against fraudulent conversions creating exempt property.
